Part 2
1.) Initial Authorship. - Any material (Material covers photograph(s) & video(s)) produced, captured, created by Refinedmoment are protected under the Initial Authorship of Charles Ouimet and no other person(s).
2.) No person(s) may download material from the internet (full list of websites can be found in section 3 (a), under Off Limits List.) that is under the ownership of Refined Moment. A person(s) may request permission from the owner (Charles Ouimet) of the material to use for their needs.
3.) No person(s) may use photograph(s) or video(s) under the ownership of Refined Moment for marketing uses, business uses and commercial uses. A person(s) may request permission from the owner (Charles Ouimet) of the material to use for their needs.
(a) - This prohibits printing and publishing (online and on paper) for the following:
Off Limits List: Mountain resorts, action sports & non-action sports companies & businesses, magazines, newspapers, brochures, catalogs, postcards, blogs, social media networking websites, search engine websites, news and information websites, personal websites, shopping, websites, portal websites (emails), weather websites, online review websites, user-generated websites, dating websites, gaming websites, TV or video websites, curation websites, photo/video sharing websites, entertainment websites.
4.) Any person(s) who does modify, reproduce, republish, upload, post, or distribute material under the ownership of Refined Moment will be charged a fee for doing so. The fee will be based off how the material is used & where it is used. The minimum fee is 300$.
